Terms of Service

These Terms of Service (the "Terms") govern your access to and use of Orpheus websites, applications, games, account systems, payments, AI generation features, and related services (the "Service"). These Terms are an operational draft and are not legal advice. Please have counsel review them before public launch.
By creating an account, accessing the Service, purchasing Ink, or using Orpheus, you agree to these Terms, our Privacy Policy, and our Content & Safety Policy. If you do not agree, do not use the Service.
1. Eligibility and adult-only access
You must be at least 18 years old to use Orpheus. By using the Service, you represent and warrant that you are 18 or older and legally able to enter into these Terms. We may suspend or terminate accounts if we believe a user is under 18 or has misrepresented their age.
2. The Service
Orpheus is an AI-powered fantasy roleplaying and interactive storytelling platform. The Service may generate story text, dialogue, characters, scenes, images, audio, summaries, gameplay state, and other content based on your prompts, choices, and settings. Features may change, degrade, fail, or be discontinued at any time.
3. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised. You may not sell, transfer, share, or allow another person to use your account without our permission.
4. User content
"User Content" means prompts, messages, character details, campaign notes, uploaded materials, choices, reports, and other materials you submit to the Service. You are responsible for your User Content and must have the rights needed to submit it.
You retain whatever rights you have in your User Content. You grant Orpheus a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify, create derivative works from, process, transmit, and otherwise use User Content as needed to operate, secure, improve, and provide the Service.
5. AI-generated content
"Generated Content" means content produced by AI systems through the Service. Generated Content may be inaccurate, offensive, unsafe, repetitive, incomplete, or similar to content generated for other users. You should review Generated Content before relying on it or sharing it. Orpheus does not guarantee that Generated Content is unique, accurate, non-infringing, or suitable for any particular purpose.
Subject to your compliance with these Terms and applicable law, you may use Generated Content for personal, non-commercial gameplay and storytelling. Commercial use requires our prior written permission unless we offer a plan or written terms that expressly allow it.
6. Content rules
You must follow our Content & Safety Policy. You may not use Orpheus to create, request, upload, store, share, or attempt to generate prohibited content, including sexual content involving minors, non-consensual sexual content, sexualized real-person imagery, doxxing, harassment, extremist recruitment, instructions for real-world violence, or unlawful content. We may remove content, restrict features, suspend accounts, or report activity where appropriate.
7. Payments, subscriptions, and Ink
Orpheus may offer subscriptions, one-time purchases, virtual credits, or usage-based features. "Ink" or other virtual credits are a limited license to access paid generation capacity or other Service features. Ink has no cash value, is not a stored-value product, is not transferable, and may not be sold, exchanged, or redeemed for money.
Prices, plan benefits, included usage, and feature availability may change prospectively. If a subscription is offered, it will continue until cancelled according to the checkout or billing portal terms. You are responsible for taxes, fees, and charges associated with your purchases.
8. Refunds
Except where required by law or expressly stated during checkout, payments are non-refundable. We may consider good-faith refund requests for duplicate charges, technical failures, or accidental purchases. To request a review, contact support@orpheus.gg with the email address tied to your account and relevant transaction details.
9. Prohibited conduct
You may not:
- violate these Terms, the Content & Safety Policy, or applicable law;
- attempt to bypass safety systems, age gates, rate limits, billing controls, or access restrictions;
- scrape, crawl, reverse engineer, or extract data from the Service except as allowed by law;
- use bots, automation, exploits, or unauthorized clients;
- interfere with, overload, damage, or disrupt the Service;
- upload malware or attempt unauthorized access to accounts, systems, or data;
- misrepresent your identity, age, affiliation, or payment authorization;
- use the Service to infringe intellectual property, privacy, publicity, or other rights.
10. Intellectual property
Orpheus and its software, branding, interfaces, designs, art direction, systems, documentation, and other materials are owned by Orpheus or its licensors and are protected by law. These Terms do not grant you any ownership of the Service or our intellectual property.
System Reference Document (SRD) attribution
Where the Service implements or references game rules or other material from the System Reference Document v5.2.1 published by Wizards of the Coast LLC, that material is © Wizards of the Coast LLC. It is used under the terms of the Creative Commons Attribution 4.0 International License (CC BY 4.0). The canonical SRD hub and downloads are provided by D&D Beyond at the link above. SRD v5.1 is also available there under CC BY 4.0; if the Service references that version, the same license terms apply to that material.
Trademarks. Dungeons & Dragons, D&D, and related marks are trademarks of Wizards of the Coast LLC. Orpheus is not affiliated with, endorsed by, or sponsored by Wizards of the Coast. This attribution satisfies the CC BY 4.0 requirement to credit the licensor and provide license and source information; it is not a claim of partnership with Wizards of the Coast.
11. Third-party services
The Service may rely on third-party providers for hosting, payments, analytics, AI models, image generation, audio, authentication, and other functionality. Your use of third-party-linked services may be subject to separate terms and policies.
12. Suspension and termination
We may suspend, restrict, or terminate your account or access to the Service at any time if we believe you violated these Terms, created risk for Orpheus or others, used the Service unlawfully, abused payment systems, or attempted to bypass safety controls. You may stop using the Service at any time and may request account deletion through available account tools or support.
13. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by law, Orpheus disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that Generated Content will be safe, accurate, available, or suitable.
14. Limitation of liability
To the maximum extent permitted by law, Orpheus will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, service interruption, or unauthorized access. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Orpheus in the twelve months before the event giving rise to the claim, or $100, whichever is greater.
15. Indemnity
You agree to defend, indemnify, and hold harmless Orpheus from claims, damages, liabilities, losses, and expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
16. Changes to these Terms
We may update these Terms as the Service evolves. When we make material changes, we will update the date above and may provide additional notice. Your continued use of the Service after changes become effective means you accept the updated Terms.
